| dc.description.abstract | A presente investigação jurídico-científica destina-se à análise da estabilidade social, sob a perspectiva da função social da norma e seu papel de tutelar os factos sociais no âmbito de um Estado Democrático de Direito. O intuito desta investigação é analisar o comportamento do sistema normativo perante a constante evolução social impelida pelo surgimento de novos factos que impactam a sociedade. A proposta em mãos abordará os seguintes objetos: a sociedade, o cidadão, o Estado e a produção normativa como reflexo dos valores históricos e culturais de um povo. O objetivo desta investigação é analisar a norma positiva como reflexo dos valores de uma sociedade e seu papel fundamental como estabilizador das relações sociais. Serão considerados a relação do indivíduo para com a sociedade, a sua evolução de um ser autónomo para a posição de cidadão, detentor de direitos e obrigações. Serão analisados os valores sociais inseridos na norma, o método de reflexão desses valores no texto e o diálogo de um sistema normativo com outros sistemas paralelos, conforme o método Dialético, Hegeliano. O resultado desta análise buscará apurar a capacidade da adequação das mutações normativas em correspondência às provocações sociais que expressam os valores históricos e culturais de um povo. Esta pesquisa visa estabelecer um paralelo entre a sociedade e a política normativa que tutela as relações sociais. A discussão proposta se encontra inserida no debate contemporâneo da busca pelo sincronismo jurídico-social, cujo intuito é minimizar o hiato entre o surgimento do facto social carecedor de tutela legal e a vigência da norma que o regulamenta. | pt_PT |
| dc.description.abstract | This legal-scientific investigation focuses on the analysis of social stability, from the perspective of the social function of the norm and its role of protecting social facts within the framework of a democratic rule of law. The purpose of this investigation is to analyze the behavior of the normative system in the face of constant social evolution driven by the emergence of new facts that impact society. The proposal in hand will address the following objects: society, the citizen, the state and normative production as a reflection of the historical and cultural values of a people. This investigation aims to analyze the positive norm as a reflection of the values of a society and its fundamental role as a stabilizer of social relations. We will consider the relationship of the individual to society, his evolution from an autonomous being to the position of citizen, holder of rights and obligations. The social values inserted in the norm, the method of reflection of these values in the text and the dialogue of a normative system with other parallel systems will also be analyzed, according to the Hegelian Dialectic method. This study determine the capacity of the adequacy of normative changes in correspondence to the social provocations that express the historical and cultural values of a people. This research aims to establish a parallel between society and the normative policy that protects social relations. The proposed discussion is inserted in the contemporary debate of the search for the legal-social synchronism, whose aim is to minimize the gap between the emergence of the social fact in need of legal protection and the effectiveness of the norm. | pt_PT |
