Os esforços pacifistas dos séculos XIX e XX são, na maior parte, determina
dos pela idéia de que a paz depende do direito internacional e dos meios jurídicos de
solução pacífica de controvérsias. O escrito À Paz Perpétua é considerado a obra prin
cipal de consagração dessa idéia, e o seu autor, o filósofo alemão Immanuel Kant, o
“fundador da filosofia da paz”. O objetivo deste artigo é analisar a crítica radical de
Kant à concepção jurídico-política de sua época. A primeira parte mostra como Kant
tomando por base o imperativo categórico em sua formulação do reino dos fins (Fun
damentação da Metafísica dos Costumes) e seu objeto, o soberano bem (Crítica da Ra
zão Prática), desenvolve sua concepção político-jurídica (Paz Perpétua e Doutrina do
Direito). Já a segunda parte demonstra como Kant reflete sobre o papel do público
racional como agente de realização do direito.
The pacifist efforts of the 19th and 20th centuries are, in most part, determined by the idea that peace depends on international law and on the juridical means of pacific conflict solution. The book Perpetual Peace is considered the leading work of consecration of this idea, and its author, the German philosopher Immanuel Kant, the “founder of the philosophy of peace”. The objective of this paper is to analyze Kant’s radical critique to the juridical political conception of his time. The first part shows how Kant, taking into account the categorical imperative in his formulation of the kingdom of ends (Foundations of the Metaphysics of morals) and its object, the sovereign good (Critique of Pure Reason), develops its political juridical conception (Perpetual Peace and Doctrine of Right). The second part demonstrates how Kant reflects on the role of the rational public as an agent of the realization of law.
