Abstract
A presente dissertação analisa o instituto da colaboração premiada, também
chamada “delação premiada”, à luz da legislação e da jurisprudência brasileira. O
objetivo é avaliar os limites jurídicos aplicáveis ao conteúdo das cláusulas contratuais
pactuadas entre as partes.
A despeito de propiciar eficiência na investigação da criminalidade organizada, a
colaboração premiada convive com críticas da doutrina pátria e estrangeira. Elas
costumam estar associadas a dois aspectos: a) violação a preceitos éticos e morais que
deveriam ser preservados pelo próprio Estado de Direito; e b) violação a direitos e
garantias fundamentais dos colaboradores e delatados.
Assim, a dissertação foi dividida em três partes. A primeira, contextualiza
brevemente o leitor em relação ao histórico da corrupção brasileira e do que representou
a OLJ no Brasil.
A segunda, explica o enquadramento legal do crime organizado, em paralelo à
colaboração premiada enquanto meio de obtenção de prova destinado a resolver crimes
dessa natureza.
A terceira, e última parte, cuida do instituto da colaboração premiada propriamente
dita, oportunidade em que há um olhar crítico sobre o conteúdo material das cláusulas
premiais e análise de cláusulas polêmicas utilizadas nos acordos firmados na OLJ.
The present dissertation analyzes the institute of awarded collaboration agreement, in the light of Brazilian legislation and jurisprudential. The purpose is to discuss the legal limits applicable to the agreed clauses celebrated by the parties. Regardless of providing efficiency in the investigation of organized crime, the awarded collaboration agreement coexists with criticism by national and foreign doctrine. They are mainly associated with two aspects: a) violation of ethical and moral precepts that should be preserved by the rule of law itself; and b) violation of fundamental rights of whistleblowers and the people who is appointed by them. Thus, the dissertation was divided into three parts. The first, briefly contextualize the reader in relation to the history of Brazilian corruption and also as to what the car wash operation represented in Brazil. The second explains the legal scheme of organized crime, in parallel to the awarded collaboration agreement as an efficient way of obtaining evidence to solve crimes of this nature. The third, and last part, takes care of the institute of the collaboration agreement itself, as an opportunity to do a critical view at the controversial clauses used into the car wash operation.
