Abstract
O presente estudo pretende abordar a mediação familiar no âmbito do ordenamento
jurídico português, pondo o enfoque na análise da questão da sua obrigatoriedade.
Para a cabal compreensão desta problemática, define-se um percurso mais amplo
que se inicia com uma breve incursão sobre os primórdios da mediação de conflitos e o
seu enquadramento no Movimento ADR. É o momento em que releva a perspetiva
histórica que envolve este meio de composição de litígios.
A dimensão doutrinário-concetual da mediação, não poderia deixar de ser
analisada, já que, in extremis, encerra tanto de complexidade como de divergência,
pugnando cada autor pelo seu próprio entendimento deste mecanismo.
As relações entre a mediação e o nosso ordenamento jurídico, são trazidas à liça
para concluirmos pela sua coexistência com os meios tradicionais de resolução de litígios,
envolvida num renovado entendimento do direito de acesso ao Direito.
Aqui chegados, detemo-nos sobre a mediação familiar. Esmiuçamos a
concetualização e adequação dos seus modelos. Temas como o divórcio, o papel da teoria
do caos na resolução dos conflitos dele emergentes, a conceção ampla e o contributo para
a escolha do modelo de mediação familiar, assumem o protagonismo. Fazemos, ainda, a
contextualização da mediação familiar noutros ordenamentos jurídicos.
O capítulo que dá nome ao nosso estudo, finaliza este trabalho. Traçamos o
enquadramento da mediação familiar em Portugal, passando pelos temas da família e
CRP, da evolução jurídica do divórcio, do novo paradigma da justiça portuguesa como
momento preliminar da análise do enquadramento, razoabilidade e conveniência da
mediação obrigatória. Após, fazermos uma breve alusão aos sistemas institucionalizados
de mediação familiar obrigatória, concluímos pela adequação da sua obrigatoriedade.
This study aims to approach family mediation in the context of the Portuguese legal system, focusing on its mandatory feature. In order to achieve a complete understanding of such issue, it is presented a succinct review of the origins of family mediation, as well as it purpose in the ADR movement. At this point it is highlighted the historical perspective of this dispute- settlement arrangement. Mediation’s theoretical and doctrinal dimension is then analysed, considering that it presents, in extremis, as much complexity as divergence, with each author demonstrating its own interpretation on this mechanism. The relation between mediation and the Portuguese legal system is also brought about to determine its coexistence with traditional means for dispute resolution, yet encompassed by a renewed understanding of the right of access to the law. Once reached this moment, we focus on family mediation, closely examining the conceptualization and appropriateness of its models. Topics such as divorce or the role of chaos theory in the resolution of conflicts that arise from it, the broaden conception and contribute when choosing a family mediation model, attain prominence. Finally, the chapter that names our study concludes this work, describing the outline of family mediation in Portugal, from family and CRP issues and the divorce legal evolution, to the new paradigm in Portuguese law as a preliminary moment for an analysis of the framework, reasonableness and convenience of mandatory mediation. And after a brief reference to the institutionalized systems of family mandatory mediation we conclude that it is suited its obligatory.
