A questão migratória no Brasil: os direitos da criança venezuelana à luz da convenção sobre os direitos da criança e os mecanismos coletivos de proteção internacional

Abstract

Este estudo investiga a situação das crianças migrantes venezuelanas no Brasil, analisando os seus direitos à luz da Convenção sobre os Direitos da Criança e dos mecanismos de proteção internacional disponíveis. A dissertação aborda a migração venezuelana, suas causas e impactos, e examina a proteção legal fornecida por instrumentos internacionais. O objetivo principal é compreender em que circunstâncias os mecanismos de proteção internacional, tanto globais quanto regionais, podem ser acionados para garantir os direitos dessas crianças. A pesquisa também avalia a responsabilidade internacional dos Estados em casos de violação dos direitos das crianças migrantes. Foram apresentados os mecanismos coletivos de proteção das crianças migrantes venezuelanas em situação de vulnerabilidade no Brasil à luz da Convenção sobre os Direitos da Criança. A análise detalha como os mecanismos globais e regionais podem ser utilizados para proteger essas crianças, destacando a responsabilidade internacional do Estado. A investigação combina métodos qualitativos e quantitativos para avaliar a eficácia dos mecanismos de proteção, abrangendo o contexto migratório e jurídico, bem como a análise específica dos direitos das crianças migrantes venezuelanas no Brasil. Conclui-se com uma avaliação sobre a eficácia prática dos mecanismos de proteção aplicados.

This study investigates the situation of Venezuelan migrant children in Brazil, analyzing their rights under the Convention on the Rights of the Child and the available international protection mechanisms. The dissertation addresses Venezuelan migration, its causes and impacts, and examines the legal protection provided by international instruments. The primary objective is to understand under what circumstances international protection mechanisms, both global and regional, can be triggered to ensure the rights of these children. The research also assesses the international responsibility of States in cases of violations of migrant children's rights.Applicable collective protection mechanisms for Venezuelan migrant children in vulnerable situations in Brazil were presented in light of the Convention on the Rights of the Child. The analysis details how global and regional mechanisms can be used to protect these children, emphasizing the international responsibility of the State. The investigation combines qualitative and quantitative methods to evaluate the effectiveness of protection mechanisms, covering the migratory and legal context, as well as the specific analysis of the rights of Venezuelan migrant children in Brazil. The conclusion evaluates the practical effectiveness of the applied protection mechanisms.
