Abstract
O julgamento do juiz Baltasar Garzon pelas suas investigações judiciais de crimes
contra a humanidade cometidos sob o regime franquista tem gerado controvérsia, não
apenas nos círculos jurídicos, mas também na sociedade civil devido a um aparente
ataque ao estado de direito (rule of law) pelos defensores do magistrado e advogados
dos direitos humanos. Este artigo tenta enquadrar o debate numa via mais holística,
defendendo o sistema judicial e o estado de direito como nucleares na defesa dos
direitos humanos, com uma abordagem atualizada à luz do Direito Internacional e,
simultaneamente, destacando o importante papel que estas instituições, e o juiz Baltazar
Garzon jogam no restabelecimento da dignidade das, e do respeito pelas, vítimas de
abusos por todo o Mundo, tentando, nesse processo, defender o primado do Direito
Internacional, a dignidade das vítimas e a necessidade de julgar as violações graves
dos direitos humanos, no quadro do Direito espanhol e do Direito Internacional
the trial of the magistrate Baltasar garzon for his judicial investigations of the crimes against humanity committed under the francoist regime has caused controversy, not least in legal circles, due to an apparent attack on the rule of law by defenders of the magistrate and advocates of human rights. this article attempts to frame the debate in a more holistic way, defending the judicial system and rule of law as central to the defense of human rights with un updated approach according to international law whilst also highlighting the important role these institutions, and magistrates such Baltasar garzon, play in re ‑establishing the dignity and respect for victims of abuses throughout the World, trying in that process to uphold the international rule of law, the dignity of the victims and the need to prosecute grave violations of human rights within a framework of spanish and international law.
