Eutanásia: direito à vida e o direito de dispor da mesma

Abstract

Até há pouco tempo o Direito à Vida – regulada no artigo 3º da Declaração Universal dos Direitos Humanos e no artigo 24º da Constituição da República Portuguesa – era completamente inviolável, tentando-se com a progressão da medicina adiar a morte o mais possível e atenuar a dor e o sofrimento dos moribundos. É sabido que hoje em dia a sociedade anseia por uma vida longa, mas vida essa sem dor e sem sofrimento, uma vida de qualidade, portanto é normal que nos nossos dias, em pleno século XXI, já se comece a debater se a pessoa não deverá ter o direito a decidir se dispõe ou não a sua vida (existem já vários projetos acerca da lei que despenaliza a eutanásia, sendo que o ultimo aprovado pelo Parlamento no dia 29 de Janeiro de 2021 está neste momento no Tribunal Constitucional para que este decida acerca da aprovação ou não da lei). Neste trabalho começo por estudar a eutanásia, como esta apareceu e os diversos tipos existentes e as suas diferenças, distinguindo também esta com certas figuras próximas, mas diferenciadas, tal como o Testamento Vital (análise da Lei n.º 25/2012, de 16 de Julho). De seguida faço uma análise doutrinal face a diversos institutos: face à Constituição da República Portuguesa, face ao Ordenamento Penal e face a outros sistemas jurídicos onde é permitida a eutanásia, como o caso da Holanda, pioneira neste assunto, e onde faço também uma breve análise das Religiões Francófona e Flamenga do país da Bélgica (que seguiu o exemplo da Holanda), pois não fazia sentido falar acerca da eutanásia sem analisar também estes sistemas jurídicos onde estas práticas, além de estarem legisladas, são comuns e aceites pela sociedade, entre outros países igualmente relevantes para esta matéria. Porém, importa também, além desta vertente jurídica, falar um pouco da vertente social, ética e religiosa, e é por isso que seguir-se-á um estudo destas questões, analisando a posição dos profissionais de saúde e da Religião Católica. Por último, e uma vez que esta é uma realidade que está muito próxima nos dias de hoje, mencionamos e estudamos os últimos Projetos de Lei: Decreto n.º 109/XIV e Decreto n.º 199/XIV. Com este trabalho pretendo discutir este tema, que apesar de já ser tão trabalhado, a verdade é que ainda continua a ser um tema controverso e tão atual.

Recently, the Right to Life - regulated in article 3 of the Universal Declaration of Human Rights and in article 24 of the Constitution of the Portuguese Republic - was completely inviolable, with the advancement of medicine trying to postpone death as long as possible and attenuating the pain and suffering of the dying. It is well known that today's society yearns for a long life, but a life without pain, without suffering, a quality life, so it is normal that nowadays, in the 21st century, we do not start to debate whether the person should Parliament have the right to decide whether or not to decide your life (there are already several projects about the law that decriminalizes euthanasia, the last one approved on January 29, 2021 is currently in the Constitutional Court so that it can be about about about whether or not to accept the law). In this work, I start by studying euthanasia, how it appeared and the various existing types and how their differences, distinguishing these with certain close, but also different figures, such as the Living Will (analysis of Law n.º 25/2012, of 16) July). Then, I make a doctrinal analysis against several institutes: against the Constitution of the Portuguese Republic, against the Criminal Order and against other legal systems where euthanasia is allowed, such as the case of Holland, a pioneer in this matter, and where I also make a brief of the Francophone and Flemish Religions of the country of Belgium (because they do not practice euthanasia without talking about the legal systems) where these too, in addition to being legislated, are common and these legal systems by society, among other countries equally relevant to this matter. However, it is also important, in addition to this legal aspect, to talk a little about the social, ethical and religious aspects, and that is why a study of these issues will follow, analyzing the position of health professionals and the Catholic Religion. Finally, and since this is a reality that is very close nowadays, we mention and study the latest Bills: Decree n.º 109/XIV and Decree n.º 199/XIV. With this controversial and current topic, which despite being worked on, it still intends to be a controversial and current topics.
