Uma análise crítica dos direitos individuais do trabalho como direitos fundamentais, humanos e sociais

Abstract

A publicação da Constituição brasileira em 1988 foi motivo de incómodo no campo do Direito do Trabalho, pelo disposto no Título II, Capítulo II – Dos Direitos Sociais, correspondente a um excesso de direitos individuais do trabalho enunciados pelo artigo 7.º, elevados à condição de limites materiais constitucionais, permanecendo assim até à presente data. É um tema que nos incomodou, incomoda, e não deixará de incomodar, pois a cidadania proclamada pelo Presidente da Assembleia Constituinte não pode significar que a rutura com a ditadura tornaria o Brasil uma nação controlada pela Constituição, impedindo o seu potencial de desenvolvimento, especialmente no campo socioeconómico. Esta investigação pretende aludir à resistência dogmática, ao trazer ao campo da pesquisa a nossa crítica desta inserção do Direito Individual do Trabalho no capítulo dos Direitos Constitucionais Sociais, num exercício comparativo com o que em Portugal viemos aprender sobre o trato com a ciência do Direito do Trabalho com os Direitos Sociais, e o que são real e cientificamente Direitos Humanos e Direitos Fundamentais. No entanto, o objeto deste estudo enfrenta grandes e sérios obstáculos pela ausência de testemunhos, quer na doutrina brasileira, quer internacional, de alguém que tenha enfrentado aberta e diretamente o tema como tentaremos construir.

The publication of the Brazilian Constitution in 1988 was a source of inconvenience in the field of Labor Law, by the provisions of Title II, Chapter II – Social Rights, corresponding to an excess of individual labor rights set out in article 7, raised to the condition constitutional material limits, remaining so to date. It is a topic that bothered us, bothers us, and will not cease to bother us, as citizenship proclaimed by the President of the Constituent Assembly cannot mean that the break with the dictatorship would make Brazil a nation controlled by the Constitution, hindering its development potential, especially in the socioeconomic field. This investigation intends to allude to dogmatic resistance, by bringing to the research field our critique of this insertion of Individual Labor Law in the Social Constitutional Rights chapter, in a comparative exercise with what we came to learn in Portugal about dealing with the science of Labor Law with Social Rights, and what Human Rights and Fundamental Rights really and scientifically are. However, the object of this study faces major and serious obstacles due to the absence of testimonies, whether in Brazilian or international doctrine, from someone who has openly and directly addressed the issue as we will try to build.
