Iniciativa legislativa dos cidadãos: Comparativo entre a União Europeia e o Brasil

Abstract

O ponto de partida desta pesquisa foi compreender o processo democrático de participação popular por meio do mecanismo de iniciativa legislativa dos cidadãos. A abordagem preliminar consistirá em uma apresentação histórico-conceitual sobre o termo “democracia”, seguido de outros conceitos relevantes que irão compor o tema dissertativo do trabalho. Contudo, o foco principal dessa pesquisa consiste em explorar as disposições normativas de participação democrática dos cidadãos europeus, no âmbito da União Europeia, fazendo um paralelo com a participação dos cidadãos brasileiros, considerando as leis vigentes, que envolvem esse instituto de Iniciativa de Cidadania, bem como estar verificando o exercício dessa prerrogativa na atualidade, no processo legislativo democrático tanto na UE como no Brasil.

The starting point of this research intended to understand the democratic process of popular participation through the mechanism of citizens’ legislative initiative, and the preliminary approach consisted first of a historical-conceptual presentation on the term “democracy”, followed by other relevant concepts in the composition of the dissertation theme of this work. However, the main focus of the study was to explore the normative provisions of democratic participation of European citizens, within the scope of the European Union, making a parallel with the participation of Brazilian citizens, considering the current laws, which involve this Institute of Citizenship Initiative, as well as the verification of the exercise of this prerogative nowadays in the democratic legislative process both in the European Union and in Brazil.
