Direito Internacional do Ambiente da Europa à América do Sul: Desafios e Previsões é
uma dissertação, baseada em revisão bibliográfica, que apresenta os traços distintivos
do Direito Ambiental nos âmbitos internacional, comunitário, regional e local tomando
como referências respectivamente a sociedade internacional, Europa, Portugal, América
do Sul e Brasil, Colômbia, Bolívia, Equador e Venezuela; aponta para o amadurecimento
do novo constitucionalismo latino-americano, um movimento erigido sobre o
plunacionalismo que traz as nações originárias indígenas à cena constitucional
tornando-as partícipes da construção dos Estados Constitucionais. Com isto a tutela
ambiental ganha novas perspectivas dada a relação especial destes povos com a
natureza. O dialogo normativo e o entrelaçamento entre ordens normativas aparecem
como elementos fortalecedores do Direito Ambiental rumo ao reconhecimento da
natureza como sujeito de direitos e tutela do ambiente como um direito indissociável dos
Direitos Humanos. O principal desafio do Direito Ambiental é atender à premência do
tema para refrear dano e risco ambientais. Além disso, a defesa jurídica do ambiente
aponta para um constitucionalismo ecológico inclusivo, o desenvolvimento da dignidade
da pessoa humana das gerações futuras e seres não humanos sencientes, a tutela e
garantia da vida plena em harmonia com a ordem ecossistêmica em que humanos e
natureza se confundem numa relação de complementariedade.
International Environmental Law from Europe to South America: Challenges and Previsions is a dissertation based on bibliographic review, which presents distinctive traits of Environmental Law within International, communitarian, regional and local fields having respectively the international society, Europe, Portugal, South America and Brazil, Colombia, Bolivia, Ecuador and Venezuela as references. It points to the maturation of the new Latin-American constitutionalism, a movement raised on the plurinationalism which brings the indigenous native nations to the constitutional scene, making them participate in the construction of the Constitutional States. With this the environmental protection gains new perspectives due to the special relation among these peoples with nature. Normative dialogue and the approach among legal systems appear as strengthening elements of Environmental Law towards the recognition of the rights of nature and environment protection as indissociable right of Human Rights. The main challenge of the Environmental Law is to meet the urgence of environment matter to refrain environmental losses and risks. Besides, judicial protection of environment points to an inclusive ecologic constitutionalism, the development of dignity of human person and sentient beings, the protection and guarantee of full life in harmony with ecosystem order in which human beings and nature exist in a complementary relation.
