Abstract
O presente trabalho trata da relação existente entre soberania estatal e imigração. A
partir da análise da evolução do conceito de soberania, aborda a dicotomia entre o poder
do Estado no controle de seu território e fronteiras e a proteção dos direitos humanos
dos estrangeiros. Estuda as mudanças originadas pelo fenômeno da globalização, além
de abordar o Cosmopolitismo de Habermas, trazendo seus conceitos acerca da
“globalização de risco” e do “cidadão do mundo”, como paradigma de uma nova relação
entre Estados e os indivíduos. Trata, ainda, da imigração no contexto nacional, europeu
e internacional, através de uma visão humanizada do Direito Internacional, com a
releitura do conceito de soberania e sua relação com a imigração. Por meio de revisão
de bibliografia e análise de normas e de jurisprudência do Tribunal de Justiça da União
Europeia, analisa o direito dos estrangeiros em terceiro país. Aborda a preocupação do
direito internacional com os direitos humanos internacionais, tendo em vista o aumento
do fluxo migratório de candidatos ao estatuto de refugiado das últimas décadas. Aborda
o direito de asilo, analisando o contexto histórico do surgimento do instituto. Apresenta
uma análise do Estatuto de Refugiado de 1951, com o estudo no princípio do non
refoulement e fornece críticas à Convenção de Viena. Por fim, destaca o direito dos
refugiados na pandemia de Covid-19.
The present work aims to address the relationship between state sovereignty and immigration. Based on the analysis of the evolution of the concept of sovereignty, it addresses the dichotomy between the power of the State to control its territory and borders and the protection of the human rights of foreigners. This work studies the changes caused by the phenomenon of globalization, in addition to approaching Habermas' Cosmopolitanism, bringing his concepts about the "globalization of risk" and the "citizen of the world" as a paradigm of a new relationship between States and individuals. It also deals with immigration in the national, European, and international contexts, through a humanized view of International Law, with a reinterpretation of the concept of sovereignty and its relationship with immigration. Through a literature review and analysis of rules and jurisprudence of the Court of Justice of the European Union, it analyzes the law of foreigners in third countries. It addresses the concern of international law with international human rights because of the increase in the migratory flow of candidates for refugee status in recent decades. It addresses the right to asylum, analyzing the historical context of the emergence of the institute. It presents an analysis of the 1951 Refugee Statute, with the study of the principle of non-refoulement and provides criticism of the Vienna Convention. Finally, it highlights the rights of refugees in the Covid-19 pandemic.
