Assédio moral ou mobbing: Soluções de Iure Condendo.

Abstract

No âmbito extra-judicial, iremos pugnar pela criação de medidas de divulgação e informação sobre o assédio moral, de modo a evitar, reprimir e travar o crescimento do mesmo; defenderemos o recurso à Mediação multi-disciplinar e à criação de Juntas Médicas de verificação de incapacidade temporária de trabalho de doentes-vítimas de mobbing. Já no âmbito de iure condendo, proporemos alteração legislativa ao Código do Trabalho, no sentido de repartir aquele ónus da prova pelas duas partes litigantes e advogaremos a criação de presunções de culpa. Defenderemos a repressão de sanções abusivas, incluindo os casos de assédio moral no elenco do artigo 331º do CT, a criação de coimas pessoais e individuais para o agressor (e não apenas para as empresas) e a inclusão do assédio moral nos acidentes de trabalho e doenças profissionais. Proporemos que seja consagrada a possibilidade de publicitar as sentenças condenatórias, como pena acessória, a expensas do infractor; a criação, como sanção disciplinar, da transferência do local de trabalho do infractor; a tutela penal das condutas assediantes, a par da continuação do seu regime contra-ordenacional e a anulabilidade da revogação ou rescisão dos contratos de trabalho (por acordo ou unilateral) obtida como resultado de mobbing. Propugnamos ainda por um regime especial de protecção às testemunhas, à semelhança do que acontece no processo penal, para facilitar a descoberta da verdade através da prova testemunhal e a criação do estatuto de vítima de assédio moral, similar ao já previsto no estatuto de violência doméstica ou na protecção da parentalidade.

In the extra-judicial scope, we will strive for the creation of measures to reveal and to inform about the moral harassment in order to avoid, to restrain and to fight its growing; we will defend the access to interdisciplinary Mediation and to the creation of Medical Boards to verify the temporary working incapacity of patients victims of mobbing. In the scope of the iure condendo, we will suggest a legal change to the Labour Code so that the burden of proof will be shared by the two litigant sides and we will defend the creation of guilt assumptions. We will restraint abusing sanctions, including the cases of moral harassment in the list of the article 331st of the Labour Code, the creation of personal and individual fines to the aggressor (and not only to the enterprises) and the inclusion of the moral harassment in the labour accidents and the professional illnesses. We will come up with the possibility of advertising the sentence of conviction, as an extra penalty, at the expenses of the lawbreaker; of moving the place of work of the lawbreaker as a disciplinary sanction; of penal custody for harassment behaviours, together with the continuing of the countermanding system and the possibility of annulment of the repeal or rescission of the labour contracts (by agreement or onesided) obtained as the result of mobbing. We will defend a special system of protection to the witnesses, as it happens in the criminal proceeding, to facilitate the discovery of the truth through the testimonial proof and the creation of the moral harassment victim statute, similar to the one already foreseen in the domestic violence statute or in the protection of parental rights.
