O segredo de justiça e a comunicação social

Abstract

O presente estudo tem por objetivo compreender “O Segredo de Justiça e a Comunicação Social”. No processo penal português, a partir da reforma penal de 2007, o segredo de justiça, passou a ser uma exceção, sendo a regra a publicidade, conforme – o Art. 86 do CPP. O segredo de justiça, impõe-se não só aos sujeitos processuais, mas todos que venham a ter contato com processo submetido a segredo, isto é, a violação do segredo de justiça que constitui crime, previsto e punido pelo Art. 371 do CP. No que se refere à Comunicação Social, dispõe o conforme o Art. 38, na CRP 1, que é garantida a liberdade de Imprensa, e os direitos e deveres dos Jornalistas. Aborda-se o “caso Casa Pia” ocorrido em 2002, em Lisboa, envolvendo várias situações de abusos de menores, onde se indiciaram várias violações do segredo de justiça na comunicação social, envolvendo autoridades públicas e políticas, e jornalistas que divulgaram informações em segredo de justiça. Podem identificar-se como decorrências do caso “Casa Pia”, a criação de Gabinetes de Comunicação Social na PGR de Portugal, e no STJ, com profissionais de Justiça e da Comunicação Social, informando numa linguagem acessível com as medias. E a liberdade de imprensa, é uma questão essencial para o Jornalismo, um direito fundamental, e indispensável numa sociedade livre e democrática. Sendo noticiados casos de interesse público, salvaguardar crianças e adolescentes da Injustiça Social, e garantir o Direito à Informação, a Tutela dos Direitos dos Arguidos e da Investigação. E ficamos a questionar, se o problema está nos profissionais da justiça ou na Comunicação Social?

The present study aims to understand “The Secret of Justice and Social Communication”. The Secret of Justice became an exception under Portuguese Legal System, to replace the advertising rule, Art. 86 of the CPP, as of the 2007 criminal reform. The Secret of Justice imposes not only procedural subjects, but everyone who comes into contact with the process submitted to secrecy, that is, the violation of the Secret of Justice that constitutes crime, provided for and punished by Art. 371 of the CP. The Social Communication according to Art. 38, in CRP, freedom of the press, and the rights and duties of Journalists are guaranteed. The “Casa Pia Case” was approached in 2002, in Lisbon, of abuses of minors, where it started violations of the Secret of Justice in the media, involving public and political authorities, where journalists released information in Secret of Justice. As a result of the “Casa Pia” case, the creation of Communication Offices in the PGR of Portugal, and in the STJ, with Justice and Social Communication professionals, reporting in an accessible language with the media, can be identified. And freedom of the press is an essential issue for journalism, a fundamental right, indispensable in a free and democratic society. Being reported cases of public interest, safeguarding children and adolescents from Social Injustice, and guaranteeing the Right to Information, Protection of the Rights of Arguidos and Investigation. And we are left to question, if the problem is in the professionals of the Justice or in the Social Communication?
