O direito da insolvência à luz da reforma de 2022

Abstract

A presente dissertação versa sobre o tema Processo Especial de Revitalização - O direito de Insolvência à Luz da Reforma de 2022, no nosso ordenamento jurídico, elaborada no segundo ano de Mestrado em Ciências Jurídicas Forenses na Universidade Portucalense. Tem como o objetivo o entendimento do Processo Especial de Revitalização à luz da reforma de 2022. Procurei, nesta Dissertação, enunciar as principais posições doutrinais e jurisprudenciais que se formaram à luz da Reforma de 2022 no âmbito do Processo Especial de Revitalização, com o propósito de identificar e analisar as soluções e ideias mais relevantes para a recuperação do devedor. Conclui que o objetivo primordial do Processo Especial de Especial de revitalização, consiste em proporcionar ao devedor credível e viável os meios adequados para a sua reestruturação, assegurando a continuidade da atividade económica e satisfação dos interesses dos credores.

This dissertation is about the theme the Special Revitalization Process - The right to Insolvency in the Light of the 2022 Reform, in our legal system, prepared in the second year of the master’s degree in forensic legal sciences at Universidad Portucalense. And its objective is to understand the Special Revitalization Process considering the 2022 reform. In this dissertation, I sought to outline the main doctrinal and jurisprudential positions that emerged considering the 2022 Reform within the scope of the Special Revitalization Proceedings, with the aim of identifying and analyzing the most relevant solutions and ideas for debtor recovery. I conclude that the primary objective of the Special Revitalization Proceedings is to provide credible and viable debtors with adequate means for their restructuring, ensuring the continuity of economic activity and satisfying the interests of creditors.
