Abstract
A presente dissertação de mestrado versará sobre a “Corrupção e a sua
Refração no Processo Penal: o caso da especial complexidade do processo”. A
corrupção é um “culto dos bons costumes” que encobre os maus hábitos. Trata-se de
uma realidade, muito presente no nosso quotidiano, e por isso, é urgente o seu
combate. Inevitavelmente, a notícia de um processo de corrupção levanta sempre um
clamor, exigindo-se a intervenção judicial. Vários são os problemas associados aos
processos de excecional complexidade o que se traduz numa demonstração clara de
que a Justiça em Portugal, na área da corrupção, não consegue assegurar uma
aplicação célere, eficaz e coerente da lei.
Em virtude disso, o presente texto tem como principal objetivo analisar a
ineficácia na investigação e julgamento do crime de corrupção.
Não obstante, através deste estudo compete-nos aferir se, perante um processo
de excecional complexidade, a Justiça será capaz de fornecer uma resposta eficaz,
adequada e em tempo oportuno recorrendo à separação de processos.
This master's dissertation will deal with "Corruption and its Refraction in Criminal Procedure: the case of the special complexity of the process". Corruption is a "cult of good behaviour" that covers up bad habits. It is a reality that is very present in our daily lives, which is why it must be combated as a matter of urgency. Inevitably, news of a corruption case always raises an outcry and calls for judicial intervention. There are many problems associated with exceptionally complex cases, which is a clear demonstration that the justice system in Portugal, in the area of corruption, is unable to ensure swift, effective and coherent application of the law. As a result, the main aim of this text is to analyse the inefficiency of the investigation and prosecution of corruption crime. Nonetheless, this study aims to assess whether, in the face of an exceptionally complex case, the justice system will be able to provide an effective, adequate and timely response through the separation of cases.
