A fase introdutória da ação executiva: o saneamento inicial da ação executiva

Abstract

O tema que me proponho desenvolver prende-se com a tramitação da ação executiva na sua fase inicial, relacionando-se com os atos processuais subsequentes à entrada do requerimento executivo em tribunal e, mais concretamente, após a aceitação do mesmo por parte do agente de execução. Por isso, o tema foi concretizado na expressão “saneamento inicial da ação executiva” e tem como objetivo encontrar um caminho, o menos sinuoso possível, para que as opções entre penhorar, citar ou remeter para despacho liminar, se apresentem de forma clara e percetível. The subject that I propose to develop concerns with the conduct of executive action in its initial phase, relating to the procedural acts subsequent to the entry of the application in court and more specifically executive after the acceptance of the same by the enforcement agent. Therefore, the theme was realized in the expression "initial sanitation of executive action" and aims to find a way, the less sinuous as possible so that the options between pawning, quote or refer to order injunction, are clear and perceptive.
