Abstract
A delação premiada, apesar de não ser um tema tão recente no ordenamento jurídico
brasileiro, apenas com a aprovação da Lei de Combate ao Crime Organizado (Lei nº
12.850/2013) e a deflagração da Operação Lava Jato no ano de 2014, ganhou relevância,
tanto do ponto de vista de sua aplicação prática quanto da excessiva exposição midiática
sobre os delatores, muitos dos quais persuadidos a aceitar acordos por intermédio do uso
disseminado da prisão preventiva, cujos pressupostos processuais frequentemente foram
corrompidos ou desvirtuados, passando o cárcere a ser empregado como mecanismo
capaz de influenciar na vontade de colaborar com a investigação e o processo. Assim,
pretende-se, por meio da presente dissertação, analisar ambos os institutos, que aparentam
estar a serviço de uma lógica penal meramente eficientista, o que pode colocar em risco o
sistema criminal e o próprio Estado Democrático de Direito ao relativizar direitos e
garantias constitucionais e permitir que normas penais e processuais penais sejam
infringidas. Apesar disso, é importante frisar que algumas recentes alterações legislativas
e decisões judiciais parecem ter percebido os abusos que vinham sendo cometidos no
âmbito do ordenamento jurídico brasileiro sob o mote propagandístico do combate à
corrupção, o que pode representar (ainda é cedo para afirmar) a retomada de um
pensamento mais alinhado à teoria garantista.
The plea bargain, despite not being a topic so recent in Brazilian legal system, only with the approval of Organized Crime Control Act (Law number 12.850/ 2013) and the outbreak of Operation “Lava Jato” in 2014 it gained relevance, both from the point of view of its practical application and from excessive media exposure on whistleblowers, many of whom were persuaded to accept agreements through the widespread use of pretrial detention, whose procedural assumptions were often corrupted or distorted, with prison now being used as mechanism capable of influencing the disposal to collaborate with the investigation and the legal process. Thus, this dissertation intends to analyze both institutes, which appear to be at the service of a merely efficientist penal logic, that can put the criminal system and the Democratic Rule of Law at risk by relativizing constitutional rights and guarantees and allow criminal and procedural rules to be broken. Despite this, it is important to note that some recent legislative changes and judicial decisions seem to have perceived the abuses that were being committed within the scope of the Brazilian legal system under the propagandistic slogan of the “fight against corruption”, which may represent (maybe it is too early to say) the resumption of a thought more aligned to the Theory of Criminal Guarantee.
