O impacto do valor das custas judiciais no acesso à justiça do trabalho

Abstract

O princípio do acesso à justiça é, indiscutivelmente, um dos mais relevantes direitos fundamentais preconizados pela Constituição de 1988., A mera existência do Poder Judiciário como centro de solução dos conflitos entre os indivíduos na sociedade moderna não basta para que todos tenham acesso a ele. Diversas barreiras se impõem na busca deste Poder, tais como a hipossuficiência financeira. O presente trabalho tem o objetivo de analisar a efetivação do “acesso à justiça”, não somente o princípio de inafastabilidade jurisdicional, mas uma análise mais ampla sobre as dificuldades econômicas, principalmente pelo alto valor das custas judiciais. Para tanto, é feita uma apresentação histórica que situa o surgimento do acesso à justiça e do Direito do Trabalho. Num segundo momento buscaremos compreender os impactos da Lei 13.467/2017, a tão questionada “Reforma Trabalhista”, no acesso à justiça trabalhista. O presente estudo abordará também alguns aspectos do Acesso à Justiça em Portugal, presente no artigo 20º, da Constituição Portuguesa, na epígrafe “acesso ao direito e à tutela jurisdicional efetiva”. Discorreremos sobre o regime de Apoio ao judiciário previsto na lei portuguesa 34/2004 e também sobre o DL n.º 34/2008, de 26 de fevereiro o Regulamento das Custas Processuais. Por fim, como este trabalho pretende mostrar as dificuldades do trabalhador na busca pela efetivação dos seus direitos, abordaremos como a Pandemia do novo Coronavírus se tornou mais um obstáculo nesta busca.

The principle of access to justice is arguably one of the most relevant fundamental rights advocated by the 1988 Constitution. The mere existence of the Judiciary as a center for solving conflicts between individuals in modern society is not enough for everyone to have access to it. Several barriers are imposed in the search for this Power, such as financial hyposufficiency. This paper aims to analyze the effectiveness of "access to justice", not only the principle of jurisdictional inescapability, but a broader analysis of economic difficulties, especially for the high value of court fees. Therefore, a historical presentation is made that situates the emergence of access to justice and the Labor Law. In a second moment, we will seek to understand the impacts of Law 13.467/2017, the much-questioned "Labor Reform", on access to labor justice. This study will also address some aspects of Access to Justice in Portugal, present in article 20 of the Portuguese Constitution, in the heading “access to law and effective judicial protection”. We will talk about the Judiciary Support regime provided for in Portuguese law 34/2004 and also about DL n.º 34/2008, of February 26, the Regulation of Procedural Costs.Finally, as this work intends to show the workers' difficulties in the search for the realization of their rights, we will approach how the new Coronavirus Pandemic has become another obstacle in this search.
