| dc.description.abstract | Surrogacy has been formally permitted in Portugal since 2016, under Article 8 of Law No. 32/2006 of 26 July, as amended by Law No. 90/2021 of 16 December. The current regime restricts the practice to cases of clinical inviability of pregnancy and prohibits any form of financial compensation to the surrogate. Formally admissive, the model has remained, in practice, inapplicable: the presidential veto of the regulatory decree in January 2024, the absence of operational regulation, and persistent institutional instability have prevented the consolidation of a functional legal framework. This thesis analyses the conditions under which surrogacy can be legally regulated in Portugal in a constitutionally sustainable manner. The central argument is that the prohibition of financial compensation does not eliminate the economic dimension of the practice–it displaces it into less controllable informal circuits, generating legal uncertainty and exploitation risks greater than those the altruistic model sought to prevent. The research argues that the constitutional admissibility of the practice requires explicit recognition of that dimension in the legal framework, as a condition for legal visibility and effective protection of all parties involved. The methodology combines doctrinal analysis of the Portuguese legal order, comparative analysis of international regimes–with particular attention to the United Kingdom, Greece and United States jurisdictions–and an ethical-legal analysis grounded in the principles of human dignity, reproductive autonomy and the best interests of the child. The research identifies structural dysfunctions in the current regime concerning the definition of filiation, institutional supervision of agreements, and the delimitation of the effects of the surrogate's consent. On the basis of that diagnosis, it formulates ten legislative proposals for the revision of Article 8 of the LPMA, aimed at correcting the identified shortcomings and establishing the normative conditions that would render the regime operational, equitable and constitutionally coherent. | |
