O terceiro setor, economia social e solidária.

Abstract

Este trabalho visa estudar um dos setores mais dinâmicos da sociedade nos dias de hoje, que é o terceiro setor, composto por diferentes pessoas coletivas e de grande diversidade concetual e jurídica. Este estudo assenta numa pesquisa documental da doutrina hoje presente em diversos espaços académicos e geográficos, de modo a compreender o que é o terceiro setor e principalmente um dos seus elementos ou subsistemas que é o setor de economia social, onde prontificam as IPSS, numa ligação aos direitos sociais e ao conceito de economia social solidária. O trabalho desta dissertação divide-se em duas partes distintas: A primeira incidirá sobre o enquadramento concetual do terceiro setor em diversas óticas e o historial das instituições. A parte final abordará, embora de forma genérica, os diferentes tipos de pessoas coletivas inclusas no terceiro setor e consequente distinção e seus elementos marcantes. Como conclusão, pretende-se fazer o enquadramento jurídico mais global do setor a partir do qual se pode partir mais tarde para o estudo das IPSS, sua ação e umbilical ligação aos direitos sociais. This work aims to study one of the most dynamic sectors of society nowadays which is the third sector, composed of different legal persons with conceptual and legal diversity. This study is based on a research on documents about the doctrine now present in many academic and geographical areas in order to understand what the third sector is and mainly one of its elements or subsystems which is the sector of social economy, where the IPSSs stand ready as a link to social rights and to the concept of a social solidarity economy. To better organize the work of the thesis, I will divide it into two distinct parts: The first one will focus on the conceptual framework of the third sector in various perspectives and the history of institutions. The second part will begin with the theoretical reflection on the different types of legal persons included in the third sector and consequent distinction and its marked elements. In conclusion, we intend to do a more comprehensive legal framework of the sector from which we can later start the study of the IPSSs, their action and umbilical link to social rights. Keywords:
