Os cartórios notariais como importante meio de desjudicialização de demandas: uma análise luso-brasileira

Abstract

O presente trabalho tem por objetivo destacar os cartórios notariais como importante meio de desjudicialização de demandas. Analisou-se a importância do descongestionamento de processos nos tribunais utilizando formas alternativas de resolução de litígios. Foram estudados como formas de desjudicialização a mediação e a realização de inventário e partilha na sucessão por morte nos cartórios notariais. Estudou-se, primeiro, a figura do notário e suas peculiaridades nos ordenamentos jurídicos português e brasileiro. Em seguida, foi analisado o instituto da mediação em Portugal e no Brasil e a atuação do notário como mediador, destacando suas vantagens nos dois ordenamentos. Em outro momento, abordou-se a possibilidade de realização de inventário e partilha na sucessão por morte nos dois países, analisando-se a evolução legislativa nos dois ordenamentos e destacando as diferenças e efetividade nos mesmos.

The present work aims to highlight notary’s office as an important means of reducing judicial involvement in matters. The importance of ease the workload of courts using alternative ways of resolving disputes was analised. Methods of ease the workload of courts such as mediation and the execution of inventory and partition in the event of death on notary’s office have been studied. First, the figure of the notary and its peculiarities in the Portuguese and Brazilian legal systems have been studied. Subsequently, the institute of mediation in Portugal and Brazil and the role of the notary as a mediator have been analyzed, highlighting the advantages in both legal systems. In another moment, the possibility of execution of inventory and partition in the event of death in the two countries was addressed, analysing the legislative developments in both legal systems, emphasizing the diferences and effectiveness on then.
