O Reino Unido, ainda presente no Tribunal de Justiça da União Europeia

Abstract

O presente texto aborda a problemática da integração do Reino Unido (RU) na União Europeia (UE) desde o seu pedido inicial de adesão, feito em 1961, até à realização do referendo, em 2016, sobre a sua permanência na União, o que despoletou a sua saída ao abrigo do artigo 50.º inserido pelo Tratado de Lisboa, assim como as consequências dessa retirada. Para tanto, o texto considera a referida disposição do Tratado da União Europeia que regula a saída de um Estado Membro da União Europeia, bem como os acordos celebrados entre o Reino Unido e a União Europeia para regular a saída, nomeadamente as disposições que regulam a jurisdição do Tribunal de Justiça da União Europeia (TJUE). O trabalho analisa ainda os vários acórdãos proferidos por aquele Tribunal relativamente a questões que foram suscitadas antes da saída do RU e outras conexas com o acordo que regula a saída da UE propriamente dito, bem como aquelas resultantes da aplicação do Direito União Europeia por parte do RU, nomeadamente a jurisprudência do TJUE nos seguintes casos: processo C-692/20; processo C-516/22; processo C-202/24; processo C-555/22 P; processo C-4/23. Por fim, o artigo tece algumas considerações finais relativamente ao impacto da retirada do RU da União e a sua contínua, mas limitada sujeição à jurisdição do TJUE.

(EN): This article addresses the issue of integration of the United Kingdom (UK) into the European Union (EU) from its initial request for membership, made in 1961, until the holding of the referendum, in 2016, on its permanence in the Union, that triggered its withdrawal under article 50 of the Lisbon Treaty, as well as the consequences of leaving the Union. To this end, the text considers the provision of the Treaty on European Union that regulates the exit of a Member State from the European Union, as well as the agreements concluded between the United Kingdom and the European Union to discipline the exit, namely the provisions that regulate jurisdiction of the Court of Justice of the European Union (CJEU). The article also analyzes several rulings handed down by that Court regarding issues that were raised before the withdrawal of the UK and others connected with the agreement that regulates the UK’s withdrawal from the EU, as well as those resulting from the application of European Union Law by the UK, namely the jurisprudence of the CJEU in the following cases: case C-692/20; case C-516/22; case C-202/24; case C-555/22 P; case C-4/23. Finally, the article presents some final considerations regarding the impact of the UK's withdrawal from the Union and its continued but limited subjection to the jurisdiction of the CJEU.
