Direito real de laje: os reflexos da lei 13.465/2017 no ordenamento jurídico brasileiro

Abstract

O presente trabalho, tem por escopo delinear o panorama estabelecido pela introdução no ordenamento brasileiro da nova Lei n.º 13.465/2017, que fez emergir uma nova modalidade de direito real, o direito real de laje. Por conseguinte, a definição da natureza jurídica do direito real de laje ainda divide juristas e doutrinadores. E, foram analisadas todas as suas vertentes e feita uma comparação com o direito português, no que concerne o direito de superfície e o direito de sobreelevação que serviu de inspiração para a referida lei. A nova lei trouxe maior visibilidade a uma problemática social das cidades brasileiras que convivem com o crescimento desordenado e ocupações irregulares. Foi feita uma análise das disposições da Lei n.º 13.465/2017, quanto à garantia de autonomia legal das unidades edificadas e sua inclusão no Sistema Registral, com a possibilidade de abertura de matrícula própria, bem como a sua tributação sob o viés do Imposto Predial e territorial Urbano - IPTU e a atualização recente sobre o direito real de laje no enunciado 669 da IX Jornada de Direito Civil. This paper aims to outline the panorama established by the introduction of the new Law 13,465/2017 in the Brazilian legal system, which led to the emergence of a new type of real right, the slab real right. Therefore, the definition of the legal nature of the slab real right still divides jurists and scholars. All its aspects were analyzed and a comparison was made with the Portuguese law, regarding the surface right and the right of super elevation that served as inspiration for the referred law. The new law brought greater visibility to a social problem in Brazilian cities that live with disorderly growth and irregular occupations. An analysis was made of the provisions of Law 13,465/2017, as to the guarantee of legal autonomy of the built units and their inclusion in the Registration System, with the possibility of opening its own registration, as well as its taxation under the Urban Property Tax - IPTU and the recent update on the real right of slab in enunciation 669 of the IX Journey of Civil Law.
