Casamento infantil: as diferentes realidades entre Portugal e Brasil

Abstract

A presente pesquisa tem como tema o perfil e as principais causas do casamento infantil em Portugal e no Brasil, buscando entender por que este último, mesmo sendo um país laico, possui índices elevados de matrimônios de crianças e adolescentes. Em outras palavras, por meio de uma reconstrução histórica-estrutural das diferentes realidades, pretende-se investigar o que justifica a discrepância entre os índices de casamento infantil dessas duas regiões, tendo como hipótese que está em nosso passado escravocrata e na falta de aplicabilidade dos marcos regulatórios nacionais e internacionais, como também na ausência de políticas públicas eficazes, o fato de o Brasil ser hoje o quarto país com mais casamentos infantis no mundo. Fazer uma comparação nesse sentido nos ajudará a fazer propostas futuras e eficientes para o caso brasileiro. This research has as its theme the profile and main causes of child marriage in Portugal and Brazil, seeking to understand why the latter, even being a secular country, has high rates of child and adolescent marriages. In other words, through a historical-structural reconstruction of the different realities, it is intended to investigate what justifies the discrepancy between the rates of child marriage in these two regions, having as a hypothesis that it is in our slave-owning past and in the lack of applicability of the national and international regulatory frameworks, as well as the absence of effective public policies, the fact that Brazil is now the fourth country with the most child marriages in the world. Making a comparison in this sense will help us to make future and efficient proposals for the Brazilian case.
