O direito ao trabalho enquanto um direito humano fundamental: respostas a uma crise no direito do trabalho

Abstract

Esta dissertação dedica-se a analisar o Direito ao Trabalho enquanto um direito humano fundamental, olhando à sua evolução, eficácia e relevância face aos desafios do mundo contemporâneo. No contexto atual, de precariedade, desemprego estrutural e profundas desigualdade sociais, pretende-se entender de que modo o ordenamento jurídico português responde à necessidade de garantir o acesso ao trabalho digno e em que medida o direito ao trabalho está articulado com outros direitos fundamentais, como o direito à vida, à educação e ao bom nome. No trabalho é adotada uma metodologia jurídico-sociológica com base funcional e orientação empírica, e são analisadas fontes normativas, doutrina, jurisprudência e diferentes realidades sociais, procurando verificar a eficácia do direito face às transformações laborais. Os resultados demonstram que o direito ao trabalho continua a ser violado ou desrespeitado, em especial nos setores mais vulneráveis da população, verificando-se uma desconexão entre a norma e a prática, alimentada pela desvalorização sindical, fraca fiscalização e modelos económicos que priorizam o lucro em vez da segurança. Entre os contributos alcançados, destacam-se propostas de reforço das políticas públicas, revalorização da educação e fortalecimento da proteção jurídica e social do trabalhador. This dissertation is dedicated to analysing Labour Law as a fundamental human right, considering its evolution, effectiveness, and relevance in light of the challenges of the contemporary world. In today’s context of precarious employment, structural unemployment, and deep social inequalities, the aim is to understand how the Portuguese legal system responds to the need to ensure access to decent work, and to what extent the right to work is interconnected with other fundamental rights, such as the right to life, education, and reputation. A socio-legal methodology is adopted, with a functional and empirical approach, analysing legal sources, doctrine, jurisprudence, and various social realities, in an attempt to assess the law’s effectiveness in the face of labour transformations. The findings show that the right to work continues to be violated or disregarded, particularly in the most vulnerable sectors of the population, revealing a disconnection between the law in theory and its application in practice — a gap fuelled by the weakening of trade unions, poor labour inspection, and economic models that prioritise profit over security. Among the key contributions are proposals to strengthen public policy, revalue education, and reinforce the legal and social protection of workers.
