Julgamento com perspectiva de gênero: uma análise comparada entre o sistema interamericano e europeu

Abstract

O presente trabalho analisa a metodologia do julgamento com perspectiva de gênero nos sistemas interamericano e europeu. Inicialmente, identifica-se o conceito de gênero e sua distinção do conceito de sexo. Trabalha-se, também, com a noção histórica das relações de gênero presentes na sociedade, bem como suas inter-relações com a epistemologia e a política. Em seguida, parte-se para o estudo da imparcialidade judicial e da existência de estereótipos de gênero e preconceitos sexistas no sistema de justiça, tanto na elaboração das leis quanto na sua aplicação pelo Poder Judiciário. Segue-se com a análise de alguns dados sobre a realidade das mulheres atualmente. Após, perpassa-se pelos principais instrumentos internacionais referentes à temática da equidade de gênero e a sua concretização pelos tribunais internacionais competentes. Ao final, conclui-se com a compilação das principais ferramentas utilizadas para a aplicação da metodologia propriamente dita, abrangendo questões procedimentais, a dogmática e a argumentação jurídica. The present work analyzes the methodology of judgment with a gender perspective in the Inter-American and European systems. Initially, the concept of gender and its distinction from the concept of sex are identified. It also works with the historical notion of gender relations present in society, as well as their interrelationships with epistemology and politics. Then, it goes with the study of judicial impartiality and the existence of gender stereotypes and sexist prejudices in the justice system, both in the elaboration of laws and in their application by the Judiciary. It follows with the analysis of some data on the reality of women today. Afterwards, it goes through the main international instruments referring to the theme of gender equity and its implementation by the competent international courts. In the end, it concludes with the tools compiled for the application of the methodology itself, covering procedural issues, dogmatics and legal arguments.
