Abstract

A influência das redes sociais no cenário político é um fenômeno mundial que coloca em xeque o conceito clássico de Democracia, segundo a teoria tridimensional do Estado. Diante desse fenômeno, o objetivo da dissertação é analisar como ambos caminham em paralelo, sendo ameaçados pela utilização de dados pessoais do cidadão para a finalidade de campanhas politicas, bem de fake news no âmbito da propaganda eleitoral para influenciar a vontade do eleitor e, consequentemente, o resultado dos pleitos eleitorais. O objetivo principal do estudo é analisar como essas más práticas digitais comprometem a Democracia e como as legislações eleitorais e de proteção de dados têm-se comportado diante dessa amea5a a fim de garantir a lisura do processo eleitoral, discutindo ainda se têm conseguido equilibrar a defesa da Democracia com a garantia da liberdade de expressão assegurada pela Carta Magna. A pesquisa evidencia ainda a relação entre internet e política e analisa as práticas tradicionais e virtuais, mostrando como as plataformas digitais foram ganhando terreno na campanha eleitoral em detrimento da TV, do radio e outros meios antigos de divulgação. The influence of social networks on the political scene is a worldwide phenomenon that puts in check the classic concept of Democracy, according to the three-dimensional theory of the State. Faced with this phenomenon, the objective of the dissertation is to analyze how both go hand in hand, threatened by the use of the citizens’s personal data for the purpose of political campaigns, as well as the use of fake news in electoral propaganda to influence the voter’s choice and, consequently, the outcome of the elections. The main objective of the study is to analyze how these bad digital practices influence Democracy and how electoral and data protection legislation has behaved in the face of this threat, in order to guarantee the fairness of the electoral process, also discussing whether they have managed to balance the defense of Democracy with the right to freedom of expression guaranteed by the Magna Carga. The research also highlights the relationship between internet and politics and analyzes traditional and virtual political practices, showing how digital platforms have been gaining ground in the electoral campaign to the detriment of TV, radio and other traditional means of dissemination.
