Abstract
Em que pese o investimento do poder judiciário em tecnologia, com o
desenvolvimento de novas ferramentas que facilitaram a vida de todos que se utilizam
do sistema de justiça, recorrer aos meios tradicionais para solução dos litígios
continua sendo uma atividade penosa para os brasileiros. São mais de 70 milhões de
processos tramitando, muitos deles com incontáveis anos de duração. Nesse cenário,
resta recorrer à meios alternativos para solução dos conflitos, de tal modo que se
garanta, a um só tempo, segurança, rapidez e resolutividade aos envolvidos. Não se
busca garantir apenas o acesso ao judiciário. Ao contrário, é preciso avaliar-se há
satisfação das partes de modo a gerar confiabilidade coletiva no sistema que se
apresenta, e sobretudo, garantir o direto do acesso à justiça. O presente trabalho
aborda os métodos complementares de tratamento dos conflitos, dentre eles a
negociação, a conciliação, a mediação, a arbitragem, as convenções processuais e
os processos de justiça restaurativa, apenas para citar alguns, como forma de
fomentar sua utilização. Antes, porém, faz uma breve digressão sobre o conceito de
justiça e o advento das ondas renovatórias. Na sequência, traça um comparativo
sobre como a matéria é tratada em Portugal. Analisa-se, destarte, a importância dos
agentes empenhados nessa tarefa de desburocratizar a Justiça, diminuir os seus
custos, reduzir o prazo de duração processual, ou mesmo evitar a deflagração da
contenda, dando-se ênfase ao pleno acesso ao Poder Judiciário, acesso este que
deve ocorrer com qualidade, mitigando à chamada ‘cultura da sentença’.
Despite the investment of the judiciary in technology, with the development of new tools that have made life easier for all who use the justice system, using traditional means to resolve disputes remains a painful activity for Brazilians. There are more than 70 million lawsuits being processed, many of them with countless years of duration. In this scenario, it remains to use alternative means of resolving conflicts, in such a way as to guarantee, at the same time, security, speed and resolution to those involved. It is not sought to guarantee only access to the judiciary. On the contrary, it is necessary to evaluate the satisfaction of the parties in order to generate collective reliability in the system that is presented, and above all, to guarantee the direct access to justice. This paper addresses the complementary methods of treatment of conflicts, including negotiation, conciliation, mediation, arbitration, procedural conventions and restorative justice processes, just to name a few, as a way to promote their use. Before, however, he makes a brief tour of the concept of justice and the advent of the waves of renewal. It then draws a comparison on how matter is handled in Portugal. It analyzes, therefore, the importance of the agents engaged in this task of debureaucratizing justice, reducing its costs, reducing the length of procedure, or even avoiding the outbreak of strife, emphasizing full access to the judiciary, access that must occur with quality, mitigating the so-called 'culture of judgment'.
