A identidade do prédio na determinabilidade dos direitos reais.

Abstract

Com este trabalho procurou-se abordar a delicada tarefa da identidade do prédio, objecto dos direitos reais de propriedade. Esta tarefa é tanto mais complexa por, historicamente, serem três as instituições encarregadas da identificação do prédio, cada uma para a prossecução dos seus objectivos e finalidades, com escassa partilha ou interoperabilidade de informação: o Instituto Português de Cartografia e Cadastro, a Direcção Geral das Contribuições e impostos e as conservatórias do registo predial. Tenta-se ainda demonstrar que o que se revela fundamental é que os prédios não sejam confundíveis uns com os outros não sendo, para isso, necessário, que a sua área se encontre matemática e milimetricamente medida, como a própria lei reconhece ao prever certas margens de tolerância. Põe-se, também, em evidência que a propriedade não é uma qualidade primária dos activos, mas a expressão jurídica de um consenso economicamente importante sobre eles, sendo a lei o instrumento que define e realiza o capital.

With this work we tried to tackle the delicate task on identity of the property, the real subject property rights. This task is particularly complex because, historically, are three institutions responsible for the identification of the property, each in pursuit of its aims and objectives, with little interoperability or sharing of information: the Portuguese Institute of Cartography and the Directorate General Contributions and taxes and the Land Registry. I t also tries to demonstrate that what is fundamental is that the property are not easily confused with each other, so therefore it is not necessary, that their area is found math and millimeter measure. It is also clear that the property is not a primary quality of assets, but the legal expression of a consensus on them economically important, and the law is the one that defines the instrument and makes the capital run.
