Abstract

A última revisão do processo executivo, levada a cabo pelo DL 226/2008, de 20 de Novembro, atribuiu novas funções ao agente de execução, a quem incumbe a direcção efectiva da acção executiva. O agente de execução tem agora especiais responsabilidades na tramitação da acção executiva, designadamente no que diz respeito à identificação e reconhecimento da verificação das condições processuais da acção, devendo dominar a matéria dos pressupostos processuais e, sobretudo, saber em que momento e qual o procedimento que deve adoptar perante a falta de um pressuposto processual. A actuação do agente de execução perante a falta de um pressuposto processual é fundamental para assegurar a regularidade da instância executiva na fase liminar da acção executiva, seja através da recusa do requerimento executivo, seja através da remessa dos autos para despacho liminar.
